The bottom line, said the Court, is that war crimes trials must be conducted under the same rules as courts-martial, though some flexibility is permitted to meet exigentcircumstances.
The Opinion notes that if the use of technology is necessary to address an imminent situation or exigentcircumstances and other alternatives are not reasonably available, it may be reasonable in limited cases for an attorney to do so without taking additional precautions.
