上诉人的对称。即不服一审法院的裁判而提起上诉的人的对方当事人。被上诉人享有上诉权、提起上诉的人为上诉人，被提起上诉的人则是被上诉人。被上诉人和上诉人的诉讼地位仅仅是由上诉行为以及上诉行为的先后顺序而决定的。与上诉人的诉讼地位是由上诉行为确定的。
