意思表示
意思表示为法律行为的核心要素，而法律行为是私法自治的实践手段，因此意思表示意义重大。意思表示，指向外部表明意欲发生一定私法上效果的意思的行为。意思表示由客观要件与主观要件构成。客观要件是指在客观上可认识其在表示某种法律效果意思。主观要件，是指内心的意思，更可分为行为意思、表示意思与效果意思。意思存于内心，是不能发生法律效果的。当事人要使自己的内心意思产生法律效果，就必须将意思表现于外部，即将意思发表。发表则须借助语言、文字或者表意的形体语汇。意思表示所发表的意思，是体现为私法效果的意思，亦即关于权利义务取得、丧失及变更的意思。
