代执行
代执行是间接强制执行的一种方式，当事人负有法定义务而不履行，此项义务可以由他人代为履行以达到同样的目的，行政机关可以自己，或请他人代为履行，由义务人负担一切费用。构成要件：(1）必须有法定义务存在，法定义务人员有义务而不履行义务时，才产生代执行的可能；（2）义务人不履行的义务是他人可以代为履行的义务，且不以义务人自为为必要；（3）代执行的实际执行人，可以是行政机关；也可以由行政机关委托第三人代为，但要向义务人征收费用；（4）代执行实施之前，一般要预为告诫，并附以期限。有时须多次告诫。在例外情况下，由于形势紧迫，也可以不经告诫即予代执行。这种情况称为即时代执行。
