上诉理由
当事人或者他们的法定代理人、辩护人和近亲属提起上诉应当用上诉状提出的理由。正当的上诉理由一般有： 1、原审事实不清，证据不足 2、适用法律不当，定罪量刑有错误 3、违反诉讼程序并因而影响裁判的正确性上诉的理由，一般是出于当事人的认为，并不一定符合裁判实际，但是根据中国刑事诉讼法的规定，只要当事人在法定期限内提出上诉，则不论理由是否正当和充分，二审军事法院均应受理。经过审查，对于上诉理由不正确或根本不存在的，可以裁定驳回。
